TERMS OF USE AND SERVICE AGREEMENT

Effective Date: June 2025

Welcome to Jobs by RecruitTech (“Platform”), a recruitment and career platform operated by RecruitTech HR Solutions (“RecruitTech”, “we”, “our”, or “us”).

These Terms govern access to and use of our website, applications, career services, recruitment services, employability programs, internship placement services, talent sourcing solutions, employer services, and any related products offered by RecruitTech.

By registering, accessing, browsing, posting jobs, applying for jobs, purchasing services, or otherwise using the Platform, you agree to these Terms.

1. DEFINITIONS

For purposes of these Terms:

Candidate

Any individual seeking employment, internships, freelance opportunities, volunteer positions, or career advancement opportunities.

Employer

Any organization, company, institution, government body, NGO, startup, recruiter, recruitment agency, or individual using the Platform to advertise vacancies or source talent.

Services

Includes but is not limited to:

  • Job posting
  • Recruitment support
  • Candidate sourcing
  • Executive search
  • Internship placement
  • Graduate trainee recruitment
  • Employability training
  • CV review
  • Career coaching
  • Interview preparation
  • Employer branding
  • Talent assessment
  • Recruitment advertising

2. ACCEPTANCE OF TERMS

By using Jobs by RecruitTech, you acknowledge that:

  • You have read these Terms.
  • You understand these Terms.
  • You agree to be legally bound by these Terms.
  • You have the authority to act on behalf of your organization where applicable.

If you disagree with any part of these Terms, you must discontinue use of the Platform immediately.

3. USER ACCOUNTS

Users may be required to create an account to access certain features.

Users agree to:

  • Provide accurate information.
  • Maintain updated account details.
  • Protect account credentials.
  • Notify RecruitTech of unauthorized access.

RecruitTech shall not be liable for losses resulting from unauthorized use of user accounts.

4. EMPLOYER ACCOUNT TERMS

Employers represent and warrant that:

  • They are legally authorized to recruit.
  • Job vacancies posted are genuine.
  • Information supplied is accurate.
  • Recruitment activities comply with applicable laws.

Employers are solely responsible for:

  • Job descriptions
  • Candidate communication
  • Interview processes
  • Hiring decisions
  • Employment contracts
  • Background verification

RecruitTech does not become a party to any employment relationship established through the Platform.

5. JOB POSTING POLICY

Employers may only post:

  • Legitimate vacancies
  • Internships
  • Graduate trainee opportunities
  • Contract opportunities
  • Freelance opportunities
  • Volunteer opportunities

Employers may not post:

Fraudulent Jobs

Jobs intended to deceive applicants.

Multi-Level Marketing (MLM)

Any role primarily based on recruiting participants into a compensation structure.

Pyramid Schemes

Any opportunity dependent on participant recruitment.

Illegal Activities

Any activity prohibited under Nigerian law or applicable laws.

Adult Services

Any role involving adult entertainment, explicit content, escort services, or related activities.

Discriminatory Jobs

Vacancies containing unlawful discrimination.

6. STRICT ANTI-PAYMENT POLICY

Jobs by RecruitTech maintains a strict anti-exploitation policy.

Employers must never request:

  • Registration fees
  • Application fees
  • Training fees
  • Processing fees
  • Equipment deposits
  • Recruitment fees
  • Visa fees
  • Security deposits

from candidates as a condition for employment.

Where RecruitTech discovers such activity:

  • Listings may be removed immediately.
  • Accounts may be suspended.
  • Accounts may be permanently terminated.
  • Authorities may be notified where necessary.

7. CANDIDATE RESPONSIBILITIES

Candidates agree:

  • To provide truthful information.
  • Not to impersonate others.
  • Not to submit fraudulent credentials.
  • Not to misuse employer information.

Candidates remain responsible for verifying opportunities before accepting employment offers.

8. RESUME DATABASE ACCESS

Candidates may make resumes visible to employers.

By uploading a resume, candidates grant RecruitTech permission to:

  • Store resume data.
  • Index resume information.
  • Display resumes to authorized employers.
  • Match candidates with opportunities.

Candidates may modify visibility settings at any time.

9. RECRUITMENT SERVICES

Where RecruitTech performs recruitment services:

Services may include:

  • Candidate sourcing
  • Screening
  • Interviews
  • Assessments
  • Reference checks
  • Talent recommendations

RecruitTech makes reasonable efforts to identify qualified candidates but does not guarantee:

  • Candidate acceptance
  • Candidate performance
  • Candidate retention
  • Hiring success

10. EMPLOYABILITY PROGRAMS

RecruitTech may provide:

  • Career readiness training
  • Internship preparation
  • Employability bootcamps
  • Graduate development programs
  • Career coaching

Participation in such programs does not guarantee:

  • Employment
  • Internship placement
  • Salary outcomes
  • Career advancement

11. INTERNSHIP AND PLACEMENT SERVICES

RecruitTech may facilitate placement opportunities.

Candidates understand that:

  • Placement depends on employer availability.
  • Placement is not guaranteed.
  • Employers make final selection decisions.

12. PAYMENT TERMS

Fees may apply to:

Employers

  • Job postings
  • Featured jobs
  • Employer branding
  • Recruitment projects
  • Subscription plans

Candidates

  • CV optimization services
  • Career coaching
  • Interview preparation
  • Premium services

All fees are payable in advance unless otherwise agreed.

13. REFUND POLICY

Refund requests may be considered where:

  • Duplicate payments occurred.
  • Service was not delivered.
  • Technical failures prevented access.

Refunds are not guaranteed once services have commenced.

14. DATA PROTECTION AND PRIVACY

RecruitTech processes information in accordance with:

  • Nigeria Data Protection Act (NDPA)
  • Applicable privacy regulations

Information collected may include:

  • Name
  • Email address
  • Phone number
  • Employment history
  • Educational history
  • Professional qualifications
  • Assessment results

Information is processed solely for recruitment and career-related purposes.

15. COMMUNICATION CONSENT

Users agree that RecruitTech may send:

  • Job alerts
  • Application updates
  • Recruitment notifications
  • Training announcements
  • Career opportunities
  • Service communications

Users may unsubscribe from marketing communications at any time.

16. INTELLECTUAL PROPERTY

The following remain the exclusive property of RecruitTech:

  • Platform software
  • Databases
  • Branding
  • Logos
  • Designs
  • Content
  • Training materials

Unauthorized use is prohibited.

17. PROHIBITED CONDUCT

Users shall not:

  • Hack the Platform
  • Upload malware
  • Harvest candidate data
  • Scrape resumes
  • Reverse engineer software
  • Misrepresent identity
  • Circumvent payment systems

Violations may result in legal action.

18. DISCLAIMER OF WARRANTIES

The Platform is provided on an “as available” basis.

RecruitTech makes no guarantee regarding:

  • Continuous availability
  • Error-free operation
  • Hiring outcomes
  • Job offer success
  • Candidate suitability

19. LIMITATION OF LIABILITY

RecruitTech shall not be liable for:

  • Hiring decisions
  • Employment disputes
  • Candidate misconduct
  • Employer misconduct
  • Salary disagreements
  • Loss of profits
  • Business interruption

Maximum liability shall not exceed fees paid for the service giving rise to the claim.

20. INDEMNIFICATION

Users agree to indemnify and hold RecruitTech harmless from claims arising from:

  • User conduct
  • Breach of these Terms
  • Violation of applicable laws
  • Misuse of Platform data

21. TERMINATION

RecruitTech may suspend or terminate accounts without notice where:

  • Fraud is suspected.
  • Terms are violated.
  • Platform integrity is threatened.
  • User conduct poses risk to other users.

22. GOVERNING LAW

These Terms shall be governed by the laws of the Federal Republic of Nigeria.

Any disputes shall first be resolved through mediation and negotiation before litigation.
